Maine disqualifies Donald Trump from the 2024 Republican primary based on the 14th Amendment's “prohibition of insurrection.” Secretary of State Sheena Bellows made the decision. Thus, Maine becomes the second state after Colorado to prevent the former president from running in the primary elections due to the events of January 6, 2021.
“I realize that no Secretary of State has ever denied any presidential candidate access to the ballot based on Section 3 of the Fourteenth Amendment. However, I also recognize that no presidential candidate has ever engaged in any insurrection. Trump has five days to go.” to appeal the decision to the state courts. Primary elections in Maine and Colorado are scheduled for March 5. The Fourteenth Amendment states, in Section 3, that public officials who have sworn to uphold the Constitution shall be barred from holding office in the future if they are involved in “Rebellion” or “riot” against the Constitution. The amendment was used against Confederate President Jefferson Davis and his Vice President Alexander Stevens (both of whom served in Congress) but since then has rarely been applied and has never been applied against a candidate for the White House. Section 3 was introduced to prevent Any civilian or military official who served in the United States before the Civil War was unable to regain positions of authority if they betrayed their country by supporting the Southern Confederacy.
The Blues will not have the final say on Trump's political career. Its decision can be appealed to Maine state courts. The US Supreme Court is expected to make a final decision on whether Trump should run for president early next year. The Maine decision shows the potential risks for Trump if the case is decided at the state level. He lost Colorado by 13 percentage points in 2020 and doesn't need that to win the presidency. But Maine divides its electoral votes by congressional districts, and Trump has twice won the state's 2nd Congressional District.
